Pregnant Workers Fairness Act

On December 22, 2022, the U.S. Congress passed the Pregnant Workers Fairness Act (PWFA) as part of the Consolidated Appropriations Act. The PWFA went into effect on June 27, 2023.The PWFA provides reasonable accommodations to employees for known limitations to pregnancy, childbirth, and related medical conditions unless the accommodation would cause undue hardship to the employer. Accommodations can include:

  • More frequent or longer paid or unpaid breaks;
  • Time off to attend to a pregnancy complication or recover from childbirth, with or without pay;
  • Acquisition or modification of equipment or seating;
  • A temporary transfer to a less strenuous or hazardous position, including light duty;
  • Job restructuring;
  • Private non-bathroom space for expressing breast milk;
  • Assistance with manual labor; and
  • Modification of work schedule.

Written requests for accommodation should be directed to Human Resources, at which time NKU will engage in an interactive process with the pregnant employee to determine a proper accommodation.
