National Science Foundation's Sexual Harassment, Other Forms of Harassment or Sexual Assault Policy

Summary

In February of 2018, the National Science Foundation (NSF) released a new policy which provides requirements for the reporting of harassment and/or assault involving Principal Investigators (PI) or Co-Principal Investigators (Co-PI) of NSF funded projects. The NSF policy requires that universities notify the agency if any NSF-funded PIs or Co-PIs are being or have been investigated for sexual or other forms of harassment.

Important Dates

The policy is applied to new awards and funding amendments to existing awards issued on or after October 21, 2018.

Institutional Requirements

Northern Kentucky University must report to NSF if NKU:

1. Places a PI or Co-PI on administrative leave related to an investigation of an alleged violation or a finding/determination demonstrating a violation of awardee policies or codes of conduct, statutes, regulations, or executive orders relating to sexual harassment, other forms of harassment, or sexual assault.

2. Imposes any administrative action on a PI or Co-PI related to an investigation of an alleged violation or a finding/determination demonstrating a violation of awardee policies or codes of conduct, statutes, regulations, executive orders relating to sexual harassment, other forms of harassment, or sexual assault.

3. Issues a finding determination regarding a PI or Co-PI demonstrating a violation of awardee policies or codes of conduct, statutes, regulations or executive orders relating to sexual harassment, other forms of harassment or sexual assault.

NKU must also report to NSF if NKU is a sub-recipient for a NSF-funded project and any of the above occur.

NKU must submit the report to NSF within ten (10) business days from the placement on administrative leave, imposition of administrative action or the date of the finding/determination.

NKU Process

The NSF notification process will adhere to current NKU policies and procedures of investigating allegations of harassment and assault. The Office of Title IX will work with the Office of Research, Grants, and Contracts to identify researchers who meet the reporting guidelines while adhering to NKU’s confidentiality requirements. The Office of Research, Grants and Contracts, who will ultimately provide the report to NSF, will only be informed if the allegation or finding warrants reporting to NSF.
